Disclaimer:

  1. The Information Technology-based Money Lending Service (“Fintech Loan”) is a civil agreement between Lenders and Borrowers, so that any risks arising from such agreement are entirely borne by each party.
  2. Any credit risks or payment default shall be borne by each Lender. No entity or national authority is responsible for any of such risks or payment default or provides compensation for the losses or other consequences arising with regards to that matter in any form.
  3. Upon approval of each User (Lenders and/or Borrowers),the Provider with the approval of the respective Users (Lenders and/or Borrowers)may accesses, acquires, stores, administermanages and/or utilizeses the Users’ personal data of Users ("Data Utilization") on or inside within the objects, electronic devices (including smartphones or phones cellular), hardwares, softwares, electronic documents, applications or electronic systems belonging to Users or controlled by the Users, by notifying the purpose, limitations and mechanisms of the such Data Utilization to the related Users concerned before obtaining such consent.
  4. Lenders who do not have sufficient knowledge and experience in the Fintech Loan business are advised not to use this service.
  5. Borrowers should carefully consider the loan interest rate and other costs in accordance with the ability to pay off the loan prior to using the Fintech Loan facility.
  6. Any fraudulent activity arising in the Fintech Loan is digitally recorded in cyberspace and may potentially be informed to the public through social media networks as well as becoming a lawful proof based on the prevailing laws on electronic information and transactions in the process of dispute resolution and law enforcement.
  7. Each User should read and understand this information before deciding to become a Lender or Borrower. The user’s decision to use this Fintech Loan facility proves that the User has understood this information.
  8. The Government, in this case the Financial Services Authority, shall not be liable for any breach or non-compliance by the User, whether Lender or Borrower (either by User's intent or negligence) of the prevailing laws or agreements or arrangements between the Provider and the Lender and/or Borrower.
  9. Every transaction and lending activity or the implementation of the money lending agreement between or involving the Operator, Lender and/or Borrower must be made through escrow and virtual accounts as required by Regulation of the Financial Services Authority Number 77/POJK.01/2016 on the Information Technology-based Money Lending Service and the violation or non-compliance against those provisions shall constitute evidence of a law violation by the Operator so that the Operator shall indemnify each User’s loss as a direct consequence of the above law violation without prejudice to the right of the suffering User according to the Civil Law.
  10. Unless otherwise specified, all definitions above refer to the definitions set out in the Terms and Conditions. Each User is required to read and understand the Terms and Conditions and Privacy Policy of Amartha.
